Corey Smith's Case: Plea Deal Reached After Lengthy Legal Battles and Misconduct Allegations

Corey Smith a figure from Miami’s Liberty City John Doe Gang during the 1990s has been involved in state and federal court cases for over three decades. Smith faced convictions in both state and federal courts related to murders weapons and drugs. He previously avoided a death penalty.
State Attorney Katherine Fernandez Rundle issued a memo and statement regarding the resolution of Smith's 2004 case in Miami-Dade County court. Corey Smith was initially arrested in 1988 and convicted on federal drug and weapon charges. At 27 he received a life sentence in federal prison without parole.
In 2004 Smith was convicted in Miami-Dade County court for the murders of Angel Wilson Cynthia Brown Leon Hadley and Jackie Pope. He received life sentences for Hadley and Pope's murders and death sentences for Brown and Wilson's murders in 2005.
A 2016 U.S. Supreme Court ruling led to a new sentencing trial for the death penalty cases in 2017 by order of Florida Supreme Court. Smith's defense team alleged in 2024 that prosecutors provided favors to potential witnesses. These favors included food drinks cigars and time for sex in a police conference room. Judge Andrea Wolfson disqualified State Attorneys Michael Von Zamft and Stephen Mitchell in March as a result.
Judge Wolfson expressed concern about potential further misconduct instances that might have been uncovered with more investigation time. State Attorney’s Office accepted Smith’s plea offer of 30 years in state prison in January 2025 to ensure the conviction integrity from 2004. Jose Arroyo evaluated the testimony and worked with other prosecutors who found much of the evidentiary hearing testimony not credible or accurate according to a January 10 memo.
Fernandez Rundle stated that witnesses had died become uncooperative or changed testimony in the almost twenty years since the 2004 conviction. In a plea deal Smith pleaded guilty to second-degree murder. This resolved the resentencing on two 2005 death sentences. He received a 30-year state prison sentence. He has already served over 24 years. He still has to serve a federal drug trafficking sentence potentially until 2051 but may have a new federal sentencing hearing.
Prosecutors waived the death penalty citing time passage witness changes and the possibility of a retrial which they deemed risky. Corey Smith was identified as the John Does gang leader and convicted for seven deaths. Jerome Fulton son of victim Angel Wilson delivered a victim impact statement criticizing both Smith and prosecutorial misconduct. He acknowledged the miscarriage of justice and urged ethical conduct from the State Attorney's office.
Judge Wolfson had removed two prosecutors due to conduct concerns. One prosecutor Michael Von Zamft was recorded discussing witness issues and suggesting making a witness unavailable if uncooperative. Judge Wolfson considered this a potentially cryptic message but did not believe witness elimination was intended. Despite this and other issues she removed Von Zamft and a colleague. Von Zamft subsequently left the office. In court Fulton showed Smith compassion offering peace and prayers against gun violence. Judge Wolfson praised Fulton's heartfelt statement.
The State waived the death penalty in November 2024 after misconduct findings. Smith had a pending Motion to Vacate Judgment and Sentence. Prosecutors cited challenges for a new trial including witness issues and a questionable jailhouse call. Smith agreed to plead guilty to second-degree murder and lesser charges receiving a 30-year state sentence concurrent with his federal sentence. With time served he faces approximately five more years in state prison on the state charge but still has a lengthy federal sentence.
